CBS News reports,
In the escalating battle between the administration and the judiciary, a federal appeals court apparently is calling the president’s bluff — ordering the Justice Department to answer by Thursday whether the Obama Administration believes that the courts have the right to strike down a federal law, according to a lawyer who was in the courtroom.
The order, by a three-judge panel of the U.S. Court of Appeals for the 5th Circuit, appears to be in direct response to the president’s comments yesterday about the Supreme Court’s review of the health care law. Mr. Obama all but threw down the gauntlet with the justices, saying he was “confident” the Court would not “take what would be an unprecedented, extraordinary step of overturning a law that was passed by a strong majority of a democratically elected Congress.” . . .
[Appeals Court Judge Jerry Smith] says the president’s comments suggesting courts lack power to set aside federal laws “have troubled a number of people” and that the suggestion “is not a small matter.”
The bottom line from Smith: A three-page letter with specifics. He asked DOJ to discuss “judicial review, as it relates to the specific statements of the president, in regard to Obamacare and to the authority of the federal courts to review that legislation.”
“I would like to have from you by noon on Thursday — that’s about 48 hours from now — a letter stating what is the position of the Attorney General and the Department of Justice, in regard to the recent statements by the president,” Smith said. “What is the authority is of the federal courts in this regard in terms of judicial review?” | |

(CNN) -- There has never been any doubt that President Obama fully accepts the Supreme Court's authority to render a definitive ruling on the constitutionality of the Affordable Care Act.
Chief executives during our history, including President Andrew Jackson in the 1830s and President Harry Truman in the 1940s, have in fact challenged or threatened to challenge the court's right to command obedience to its understanding of the Constitution, but Obama certainly is not among them.
As a brilliant constitutional lawyer deeply devoted to the rule of law, he has nothing but respect for the critical function that judicial review performs in preserving the American system of constitutional government.

What an F*ing joke. There is barely any evidence he ever went to college, there is no evidence he ever graduated. His law degree, if he actually has one, was never used as there is no record he ever took the bar or practiced law. And the idea that he has "nothing but respect" for the judicial system or Constitutional government is belied by every action he has taken as president, not just his latest statements.

| It doesn't matter how intelligent you are or how much education you have If you have Ideology mixed in, you turn out to be a moron. This president is an ideologue and as so, he will stick to his guns right down to where the ship of state plows into the iceberg of reality. That's why we need to boot his rear end out and get a captain that can see farther than his ideals. | |

| It's obvious that Obama has no respect for the Constitution; he's thoroughly proved that in his voting record. Unfortunately, most Republicans share his disdain for Constitutional limits to federal power, and their oaths of office are sick jokes. On us.. | |
