Jury selection begins Tuesday in what is sure to be a controversial case in the Bay area.
Trevor Dooley, 70, is on trial for manslaughter in the death of David James. Dooley has tried getting the case thrown out using Florida's Stand Your Ground law, a motion that was denied by a judge.
Two years ago on a Valrico basketball court, Dooley shot and killed James during an argument. Dooley said James was choking him and he was trying to get a gun out of his hand when it went off.
It all happened in front of James' young daughter, who is expected to testify at the trial.
The shooting happened at the Twin Lakes of Brandon subdivision in Valrico, where James and Dooley both lived. Dooley came over to the court with a loaded gun on him to chase away the skateboarder.
James stuck up for the teenager. Witnesses say Dooley, swearing at the man, started walking off, but it didn't end there.
Dooley did have a concealed weapons permit, and investigators say James was much larger in size than Dooley.
